Abstract
Imprisonment has a long history in human history. Imprisonment has had many ups and downs throughout history. In Imami jurisprudence, limited cases of imprisonment are mentioned. Therefore, the jurists have raised complete and comprehensive discussions in other jurisprudential cases, only sporadically and in some branches, regarding imprisonment. The scope of research on the issue of imprisonment, in different fields and dimensions, does not have much history, and one of the related and less discussed issues related to the issue of imprisonment refers to the establishment of a proportional relationship between the process of issuing and executing the punishment of imprisonment in the field of penal crimes (according to according to the principles of criminal law) and the institution of the family (according to the policies of the Supreme Leader). The research method is descriptive and analytical using library resources. In the current research, it was tried to discuss and investigate the family-centered approach to the process of legalization, issuance and execution of the prison sentence. It was found that one of the most important reasons given by those in favor of de-imprisonment and the use of alternative punishments is the destructive and unfortunate effects that the issuance and execution of a prison sentence has on the family of the convicted person, even though the policy of de-imprisonment is also It has been noted in the above documents as well as in the normal laws, the writing of some criminal regulations in our country has been in such a way that this goal is not fully met and on the contrary, it causes the increase of the criminal population.
