Abstract
Abstract

Purpose: The right to have the highest attainable standards of health or the right to health is one of the human rights whose importance is emphasized in human rights documents. Personal health is considered as one of the most important components of the dignity of every human being. Therefore, the right to health is recognized as one of the fundamental human rights in the international human rights system.

Materials and Methods: This research was done with the method of library studies and in a descriptive-analytical way, which was obtained and analyzed by referring to Holy Quran and jurisprudential-legal evidences.

Findings: Examining Islamic sources, including verses, narrations, and jurisprudence books, shows that the religion of Islam also emphasizes the need to preserve and improve people's health. Having the right to life and health is one of the natural human rights that God has given to mankind. and agrees with human dignity. And every creature, even animals and plants, have the right to life and health. . This is where the right to health, as an internationally recognized right, questions the legitimacy of this phenomenon, and the Holy Qur'an also warns people against endangering their health and says: "Walatulqwa bi-aidikum il-lai-al-tahluqa" (Baqarah195).

Conclusion: The Holy Qur'an, jurisprudence and medical law have recognized the right to health. Since the jihad of marriage is in clear contradiction with the right to the health of individuals, therefore, based on the aforementioned evidence, one can comment on the impermissibility and necessity of preventing its conclusion.
